PLANNED GIVING Sample Will Clauses
The following clauses are provided for your assistance,
but are intended only as illustrations of the types of clauses that
may be appropriate. Any person considering the inclusion of clauses
of this type in his or her Will should discuss with his or her own
legal advisor the specifics of their situation.
Gift of a Sum of Money
"To pay to the Royal Columbian Hospital Foundation, the sum of $ ___________.
Gift of a Particular Asset such
as real estate, stocks, bonds, or art.
"To transfer to the Royal Columbian Hospital Foundation, [description of
property]."
Gift of a Portion of the
Estate
"To divide the residue of my estate into _____ equal shares, and to pay
or transfer [#] of such equal shares to the Royal Columbian Hospital Foundation."
Gift of All of the Estate (or
remainder after specific bequests)
"To pay or transfer the residue of my estate to the Royal Columbian Hospital
Foundation."
Gift to take effect Following
the Death of a Lifetime Beneficiary
You may want to provide for a spouse or other loved one during that persons
lifetime, and at the persons death make a gift to the Foundation.
Your Will would create a Trust for the person, and then provide for either
a specified amount, a share or the residue or the entire residue to go
to the Foundation at that persons death, as follows:
"Upon the death of __________________,
to pay the sum of $ ____________to the Royal Columbian Hospital
Foundation." or
"Upon the death of __________________, to divide the residue of my estate
into _______ equal shares, and to pay or transfer [#] of such equal shares to
the Royal Columbian Hospital Foundation." or
"Upon the death of __________________, to pay or transfer the residue of
my
estate to the Royal Columbian Hospital Foundation."
Gift for a Particular Purpose
If the gift is to be used for a particular purpose, the following words
should be added:
...to be used for ________________(the "Fund"). If unforeseen
circumstances make the specific use of the Fund no longer practical or
desirable, the Foundation is authorized to make such changes to the use
of the Fund that it considers desirable, provided that the changes are
in keeping as far as possible with the spirit and general intent of this
gift." Note: you can establish an endowment fund in your lifetime,
and enrich it through your Will.
Gift of Lapsed Bequest
You may want to make a gift to the Foundation if a person to whom you have
left a gift dies before you. The following wording could be used:
"In the event that any bequest contained in this my will shall by reason
of death of any named beneficiary, or for other reason, fail to take effect,
the said bequest shall be paid or transferred to the Royal Columbian Hospital
Foundation, to be used as the Foundation shall determine."
Receipt of Gift by the
Foundation
If you are making a bequest to the Foundation, it will assist your executor
to include the following clause in your Will:
"The receipt of any person purporting to be an officer of the Royal Columbian
Hospital Foundation, for the value of my bequest shall be a sufficient discharge
to my Trustees. My Trustees shall not be required to inquire into the authority
of such person to give a valid receipt nor to see the application of my bequest."
